In this course, we will be focused on prohibited acts and practices and enforcement actions by the AZ-DIFI. Chapter 1 will dive into acts that Arizona MLOs are prohibited from engaging in. In Chapter 2, we will discuss enforcement taken by the DIFI against mortgage industry members for fraud and other serious acts.

- Explain the powers of the Deputy Director of the Arizona Department of Insurance and Financial Institutions, particularly in terms of investigating complaints, taking action on violations, and the conditions under which a mortgage loan originator’s license can be denied, suspended, or revoked.
- Identify the specific criteria that may lead to the denial or revocation of a mortgage loan originator’s license, including dishonesty, violations of laws or regulations, criminal convictions, and failure to meet financial responsibility standards.
- Describe the prohibited activities for mortgage loan originators, such as receiving compensation without proper licensing, making false promises or misrepresentations, and accepting or disbursing funds improperly.
- Understand the legal requirements regarding blank spaces in mortgage loan documents, including the necessity for a Blank Spaces Authorization Disclosure and the consequences of non-compliance.
- Examine the potential penalties for violations of regulations, including civil penalties, and the impact that non-compliance can have on the mortgage industry, individual professionals, and consumers.
- Foster a more thorough understanding of what constitutes a prohibited act under Arizona law.
- Prepare students to detect fraud within their loan files.
- Arm students with the confidence to bring questionable loan files to a “hard stop” when required.
